Terms of Use

1 Agreement to Terms

By downloading, installing, or using any application developed by Franzkuala ("Developer", "I", "me"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Apps. These Terms apply to all applications published on the Apple App Store and Mac App Store (collectively, "Apps").

2 License Grant

Subject to compliance with these Terms, I grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices you own or control for personal, non-commercial purposes.

This license is governed by the Apple Standard End User License Agreement (EULA), incorporated into these Terms by reference.

3 Restrictions

You agree not to:

• Copy, modify, or distribute the App or any portion of it
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or sublicense the App
• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any systems connected to the App
• Remove or obscure any proprietary notices or labels on the App
• Use the App to transmit malicious code, viruses, or harmful data

4 Purchases and Subscriptions

One-Time Purchases

Some Apps are available as a one-time purchase. Upon purchase, you receive the license described in Section 2.

In-App Purchases and Subscriptions

Some Apps offer optional in-app purchases or subscriptions processed by Apple, subject to Apple's Terms and Conditions. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage subscriptions in your Apple ID account settings.

Refunds

All purchases are final and non-refundable unless required by applicable law. Refund requests must be submitted to Apple through their standard refund process.

5 Intellectual Property

The Apps, including all content, features, functionality, graphics, logos, and code, are the exclusive property of Franz and protected by copyright, trademark, and other intellectual property laws. You retain ownership of any content you create using the Apps.

6 User Content

Content you create within the Apps is owned by you. I do not claim ownership rights over your content. You are solely responsible for the content you create and any consequences of using or sharing it.

7 Privacy

Your use of the Apps is also governed by our Privacy Policy, incorporated into these Terms by reference. By using the Apps, you consent to the data practices described in the Privacy Policy.

8 Third-Party Services

The Apps may integrate with or link to third-party services such as Apple's iCloud. Your use of those services is governed by the respective third-party's terms and privacy policy. I am not responsible for third-party service practices.

9 Disclaimer of Warranties

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. I do not warrant that the Apps will be uninterrupted, error-free, or free of harmful components.

10 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FRANZKUALA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. In no event shall total liability exceed the amount paid by you for the App in the twelve months preceding the claim.

11 Indemnification

You agree to indemnify and hold harmless Franz from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Apps or violation of these Terms.

12 Updates and Changes

I may release updates from time to time. Updates may be required to continue using certain features. I reserve the right to modify or discontinue any App at any time, with or without notice.

13 Termination

These Terms are effective until terminated. Your rights will terminate automatically without notice if you fail to comply with any provision. Upon termination, you must cease all use of the App and delete all copies from your devices.

14 Apple as Third-Party Beneficiary

You acknowledge that Apple, Inc. is a third-party beneficiary of these Terms and, upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.

15 Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of law provisions. Any dispute shall be subject to the exclusive jurisdiction of the courts in San Francisco County, California.

16 Changes to These Terms

I may modify these Terms at any time. Changes are effective when posted. Continued use of the App after changes constitutes acceptance of the revised Terms.
